Summary of Responsibilities

The Onsite Mediator is a well qualified and professional mediator whose primarily role is to serve the courts and court litigants with family mediation services based on referrals from the the Ontario or Superior Courts of Justice in Brampton and Orangeville and the Unified Family Courts in Newmarket.


The Onsite Mediator facilitates mediations based on imminent or narrow issues before the courts or for matters referred to onsite services from the judiciary, duty counsel and other referral sources. The onsite mediator and is required to always assess and screen for appropriateness for mediation at all times.


Required Skills and Competencies

· Must be an accredited family mediator through the OAFM or similar certifying organization;

   Advanced knowledge in mediation skills and competencies;

· Advanced knowledge in screening for domestic violence, abuse, power imbalances and capacity and safe termination;

· Advanced knowledge in family mediation code of ethics/conduct or standards of practice for family mediators (OAFM, FMC, ADRIO or FDRIO);

· Direct and extensive experience mediating complex family law cases, especially in a court environment;

· Excellent, timely and detailed file management skills;

· Advanced knowledge in substantive areas of family law, including but not limited to decision making, parenting, child support, and may include competencies in spousal support and property and financial division of assets;

· Knowledge in the use of mediator software tools such as DivorceMate;

· Advanced knowledge in community referrals for onsite mediation clients in the court location they may be working;

· Advanced knowledge in skills and competencies relating to high conflict situations, and documentation requirements (such as financial disclosure);

· Excellent process design skills and agility techniques;

· Excellent and detailed drafting skills for Mediation Summary Reports.


Responsibilities (including but not limited to):

· Coordinate and process all on-site referrals for mediation from judges, duty counsel, court personnel, lawyers and from individuals themselves;

· Actively engage with court stakeholders daily to promote mediation services;

· Conduct intakes for mediation, screen for domestic violence and mediate narrow issues of appropriate cases;

· Ensuring full case management of onsite files from opening case, ensuring necessary forms are in the file, working with admin to send MSRs to clients, auditing personal onsite files at the end of each onsite day, closing personal onsite files at the end of each onsite day, and any required follow-up with files if necessary;

· Promoting mediation amongst the bench, duty counsel, court personnel, lawyers and clients about onsite mediation and the PFMS mediation service;

· Increase the integration of the mediation service with the justice system;

· Enhance the on-site mediation client’s overall experience of the legal system;

· Attend and participate in monthly/periodic meetings and trainings (provided free of charge for roster members);

· If applicable, provide mentorship to mediation interns and participate in student or peer knowledge or skills sharing;

· Ensuring compliance to accommodation and linguistic needs for onsite clients;

· Explore new methods and approaches in the delivery of mediation services with a view to maintaining quality assurance with the provision of mediation services;

· Assist the Information and Referral Coordinator at FLIC with mediation consults, information referrals, and screening protocols or for breaks, if necessary;

· Submit necessary timesheets to managers and monthly invoices to the ED;

· Maintaining necessary statistics if required;

· Participate with at least one (1) community outreach, court mediation education and events, event planning assistance per year, such as the MIP or an outreach event.
